This was posted here earlier under lock, but I think it is important enough to post to the wider community.

Ning is the back bone provider for various video hosting sites like BAM Video Vault.  Their copyright policy is consistent with most other sites - which is - if they get a DMCA takedown request, they will comply, remove your work and give you the opportunity to file a counter notice. If you (or your social network) get too many DMCA notices, your account (or the networking site) may be shut down. Ning did this last year when too many of their Adult video networks received multiple DMCA notices from the porn industry - now, you cannot host any adult video content on Ning's platforms.

One thing to note: the concept of being a ‘repeat offender’ on Ning covers all of your accounts in all social networks hosted on Ning. In other words, the strikes can mount up and impact all accounts across all networks.


Starting this week, vidders on Buffytube (hosted on Ning) began receiving takedown requests from 20th Century Fox.  An excerpt from Ning's standard DMCA notice is included below. The Buffytube mods are closing the site and moving it elsewhere.

For those who are concerned about streaming quality at BAM but like the social networking aspects, you can embed video from other streaming sites such as YouTube. (For discussion on streaming quality at BAM and other video sites, see here.)

[livejournal.com profile] vidderkidder has kindly updated the FAQ at BAM to show where to embed video from other sites.

For vidders who choose to embed at BAM from their own websites, the embedding codes are pretty much the same as the ones for here on LJ. That tutorial is here. Be sure to check that your host allows streaming.

From BAM's FAQ:

Important :"Embedding a vid that is hosted on your website here on BAM means that you are allowing others to also embed your vid. This is why keeping an eye on your website's bandwidth will be important. You may also want look into your website's protections against hotlinking."

Also, another site being suggested for streaming is Fliggo. It'd be interesting to see what sort of quality people find from that site.

I've successfully uploaded  3 vids to Blip tv - two in the last few days &  one this morning.They all seem to run ok.  This afternoon 3 attempts to upload another vid compressed in the same format (Xvid AVI) and one as WMV (in desperation) has resulted in no video, just audio and a white screen.

I've put in a contact note to Blip but I was wondering if anyone else has had this problem recently.

At [livejournal.com profile] morgandawn's suggestion, I'm posting this streaming quality comparison info here.

A few days ago, [livejournal.com profile] jagwriter78 asked the admin at BAM Vid Vault about an issue she had with the frame rate of one of her vids. It looked like during the conversion process, the resulting FLV file had dropped frames. I've seen a few complaints about this elsewhere on LJ.

Anyway, I wanted to confirm if this was true, that BAM's video player drops frames. Jag's "Owen Harper - Deceased" vid illustrates the dropped frames quite well with lots of fast intercutting. I poked around in my cached files and got the FLVs from several sites and used FLV Player to look up the info. By using the cached files versus using various downloaders, I know for sure that these FLVs are what's streamed from each site rather than FLVs that get converted.

Jag's self-encoded FLV:

For reference, though I can't do an exact comparison as Jag's vid is unavailable there, I also have a short clip I uploaded to YouTube. It's available in both standard and HD quality.

The only difference that I can see between YouTube's HD mp4 file and the one I originally uploaded is that mine had audio at 48,000 Hz.

The vids are all down at imeem.

The playlists are not down, yet. So if you haven't deleted your account already, you can save your own playlist (the list, not the vids). Click on the actual playlist (it looks like it will play, but it won't -- but it doesn't redirect to the home page either). Then click "organize video playlist" -- this will launch a popup window that lists all of the vids.

It only works on your own playlist(s) when you are logged in, alas, not on playlists made by someone else. I wouldn't count on this working very much longer, so if you want to do it, do it soon.

The pathetic blog post where imeem announced the upcoming video annihilation initially did not have comments enabled. But it does now (as pointed out in this article on ReadWriteWeb) so I left a commment.

The comment is still "awaiting moderation" even though at least one comment posted after it has passed through moderation.

So, I am putting the comment here for posterity. And to make me feel better.

ACTUALLY, hundreds if not thousands of your users come here solely to WATCH VIDEO. imeem was not founded as a music-focused service and SOME of us have been here long enough to remember that.

I am appalled at the dismissive way you are treating us. 5 days warning — on a blog post, no less — is really rude and it is not enough time to relocate all of our user-created and user-uploaded content. We will be losing comments, view counts, interpersonal relationships, thousands of playlists and more.

You COULD have emailed or PMed users that have uploaded, favorited, commented on, or made playlists of video content, but you did not and still have not.

You COULD have given us more advance warning. When Ning booted their Red Light District they gave 35 days notice — SEVEN TIMES LONGER.

I have copies of MY OWN video and photos, but you are removing my ability to access videos made by other people. Thousands of browser and delicious bookmarks are instantly dead. Links embedded in academic journals, scholarly articles, and blog posts: dead. Favorites: disappeared. Playlists: disappeared.

I am done with your service and I do not wish you well.


I left a more polite version of this comment on the ReadWriteWeb article, and I also ranted at length about imeem in my LJ.

One of the reasons this is driving me nuts is that I've collected over 4,360 LiveJournal (and other blog) vid rec entries in the delicious account for [livejournal.com profile] veni_vidi_vids. And so, so many of those LJ entries link directly to the imeem stream. And it seemed safe enough! Certainly safer than directly linking to a youtube vid.

Beyond the fact that some vids and vidders ONLY EXIST on imeem right now (I am mostly optimistic that vidders will eventually choose to reupload on a different streaming site) it really makes the whole archive of vid recs much less useful. I was searching for one vid earlier and 7 out of 8 recs linked to the imeem stream. (The vidder's LJ had no obvious link to the vid at all). But that 8th rec did help me find a DL link, so searching the delicious account using "viddername" and/or "fandom" can help locate DL links or alternate streaming links.

Now that so many vids are going to be in limbo, there's always [livejournal.com profile] vidfinders. [livejournal.com profile] vidding indexes by fandom tags (recently) and by fandom-specific memory categories for older vids. (It's a really good idea to cross-post your vid to [livejournal.com profile] vidding as well as the fandom-specific comm and your LJ. Just remember that [livejournal.com profile] vidding doesn't allow graphics unless they are under a cut.)

Vidders: consider a sticky post at the top of your LJ or a link in your profile. Yes, even if you've only made a few vids. Yes, even if you think everybody knows where your vids are. Some people are streaming at BAM and some at vimeo and some on youtube and some at blip.tv and some at viddler, etc.

I caution vidders as we move en masse away from iMeem to other streaming alternatives - how the new services will handle the transformative nature of fan vids is still anyone's guess.

1. Blip.TV - [personal profile] cesperanza has posted about Blip.TV's copyright policies. They state: "An exception to this rule is if the work as a whole is transformative. Transformative means making something substantially new is created from the copyrighted work." More here

Edited update: Blip.TV has deleted one vidder's account within days of her uploading her vids: "In your case the videos were either major copyright violations or made up a significant enough portion of your show that we felt that the only responsible thing for us to do was to revoke your account." more here

2. BAM Video Vault is a social networking community created for vidders by vidders. Friendly to vids? You betcha! But remember, BAM is built on Ning's platform, and Ning recently had to discontinue adult video services:
"Removal of Adult Networks. In December 2008, Ning announced that it would no longer host adult networks. Adult network owners were given just over a month to move their adult content to another provider. The reasons cited for removing adult networks from the platform were that they didn't cover the costs of providing them and that they created a disproportionate amount of DMCA takedown notices for copyright infringing material. 3. Viddler offers the standard DMCA/copyright policies. Like Vimeo they ask explicitly during upload to verify you have ownership of the material you're uploading and call out TV shows or music videos.
"Only use clips you own! We'd appreciate it if you didn't upload copyrighted material, like TV shows or music videos" Like Vimeo, you can privately embed music videos, but that still does not make Viddler any more (or less) 'fan vid friendly' than other streaming sites.

Where does Vimeo fit in all of this? They offer excellent streaming quality, but their business model actively frowns on ;non-user generated 'footage. We've blogged about this several times. And even password protecting your vids will not prevent your Vimeo account from being disabled.

As long as the RIAA and the MPAA continue their 'take no prisoners, leave no one alive" policies towards their user base, no one single video site will be 'secure'. In addition to the ever-present copyright issues, there may be financial reasons for a video streaming service to stop streaming (ex iMeem).

My best suggestion - pick two sites and keep both active and current. Diversify!

FYI: The DownloadHelper extension for Firefox is one of the few that works with imeem. It lets you save as flv, or download and convert to another format.

I'm posting this in response to the news posted by [livejournal.com profile] vchrusch that Imeem will no longer be allowing vids on their site.

Here's the tutorial for how to stream on LJ.

This tutorial shows you how to stream video from your own website using free software and HTML. The settings here are for SUPER (Win only) which are different than the ones I use with On2's Flix ($39 Win or Mac). It seems that Flix generates better quality, and to me, it's an easier program to use. [livejournal.com profile] guest_age has also recommended Visual Hub for Mac users.

It seems that Imeem is going to be removing all user generated video content on June 30th. The news about it is posted here

I heard about this from a friend who does stop motion animations and was wondering if anyone had ever tried it.

Apparently, if you speed up the music to 103% or slow it down to 97%, you still get music that sounds right but, trips up the bots that comb for copyright violations.

My dispute was unsuccessful, so I guess that's that. I still don't understand why my video was yanked when there are a several Burn Notice videos on YT that are sitting there untouched.

Vid Theft

Three years ago I posted this vid to youtube (http://www.youtube.com/watch?v=JrQ0W3qLKeA) the music originally was Unforgiven by Metallica. The original audio was removed due to a copy right claim on the song but I changed the music and kept the vid for sentimental reasons.

So I was very surprised to find my vid, in it's original form, uploaded here (http://www.youtube.com/watch?v=9ue2cHSQnmM&feature=related). The audio is different but the video itself is identical, they even kept the "vid made by natgel" credit in the end.

I've left a comment and sent a pm to the maker, my pm was ignored and my comments deleted. I commented again but I don't have high hopes.

This is actually my first music video and is in fact very important to me.
Can you guys help me take down this video? If more people comment on it maybe he or she will take it off. I tried not to make a big deal of it, but it's really really annoying.

I followed the advice of several folks here and disputed YouTube's yanking of my vid. It worked, the vid is up, at least for now. They're not allowing me to embed it for some reason. It's possible it won't stay up for long.

Does anyone have any idea why YouTube insists on yanking my vid on the grounds that it contains copyrighted material by FOX when it doesn't? It's a Burn Notice video with a Bruce Springsteen song. Neither has anything to do with FOX. There are plenty of Burn Notice and Bruce Springsteen vids on YouTube. This is nuts.

Sorry to bother everyone, but I'm at the end of my rope and so I'm taking a chance. I'm looking for someone!

Back when YouTube was doing a ton of takedowns, me and some people from OTW were posting a lot about how to dispute a YouTube takedown, and someone who was encouraged to dispute a takedown or block replied in a comment that, well, it was her daughter's vid, and she didn't know how her daughter had made the vid, and if the making of the vid was illegal in itself, and so she didn't really want to risk making a dispute claim with YouTube. Is this you? If this is you or someone you think you might know--how many mother-daughter fan vidders are out there?--could you please comment or drop me a line at cesperanza at gmail dot com? "iMeem, the free streaming music site backed by Sequoia Capital, Warner Music and other prominent investors, is rumored to be in serious trouble.

Music insiders are saying a shutdown of the company is imminent after a failed attempt to sell the company or raise more cash. A spokesperson flatly denied the shutdown rumors today, but confirmed that the company layed off staff last week (six people from a staff of around 70). He wouldn’t comment on funding or sale rumors, although plenty of potential buyers tell us they’ve been pitched to buy the company over the last year."
