Hello, I've just discovered that one of my vids has been blocked on YT because of the music. I don't vid very often and this vid is two years old, but I guess I woke a dragon.

Still, it's a bit gutting. I'm not sure what to do now - is there somewhere else I can post it? Should I bother to dispute it? Start a Tumblr/Vimeo account? idk

Yes it is worth disputing.  Sometimes just filing the initial dispute will resolve it. Here is a great write up of a vidder who went the entire distance. Even if you want to only fill out the initial paperwork, it will help.
In the meantime, here's what you do
1. Create an AO3 account. You will use this to embed your vids and link to it in your vids posts.  This is where people will leave you comments and feedback...that way, if your vid is taken down,  you only need to update the new in one location (your AO3 post). And your comments and kudos won't get deleted.
2. Host your vid in two locations  - vimeo or vidders.net can be one. The other should be Critical Commons. I'd embed Vimeo/Vidders.net and add Critical Commons  as a link to any vids post. If the vid is blocked in only a few countries, add a link to your AO3 placeholder in the notes section (If your vid is blocked in X and Y country, head over here for alternatives). 3. Touch bases with Vidders.net about backing up your entire YouTube channel - including comments.

You have the option to self-identify with a name (real name or fandom name) and provide an email address for follow-up questions, but this section is not a requirement for completion of the survey. All data collected from this survey will be reviewed by the principal investigator only, accessible through a password-protected site where all survey data will be stored. The information will be summarized for a report that will be presented to fellow students, as well as made publicly available online.

Qualifications: In order to participate in this study, you must be a fanvidder above the age of 18. Fanvidders are defined as those who have participated in the act of vidding, creating music videos that combines source content from popular media through video and audio materials and re-purposes it in a new way.

The OTW's Fan Video & Multimedia Committee is once again working with the Legal Committee and the Electronic Frontier Foundation to petition for a DMCA exemption granting vidders, AMV makers, and other creators of noncommercial remix video the right to break copy protection on media files. In 2010, we won the right to rip DVDs; in 2012, we got that exemption renewed and expanded to include digital downloads (iTunes, Amazon Unbox, etc.). In 2015, we'll be pushing to add Blu-Ray—and, of course, to renew the exemptions we've already won in the last two rounds of DMCA rulemaking.

And we need your help to do it! If you make or watch vids, AMVs, or other forms of fan video, we need you to tell us:

1. Why making fan videos is a transformative and creative act;
2. Why video makers need high-quality source;
3. Why video makers need to be able to manipulate source (change speed and color, add effects, etc.);
4. Why video makers need fast access to source (such as using iTunes downloads rather than waiting for DVDs);
5. Why video makers need to be able to use Blu-Ray;
6. Why video makers need to be able to use streaming sources; and
7. Anything else you think we should keep in mind as we work on the exemption proposal.
ETA: We're also looking for vids that we should add to the Fair Use Test Suite, and we'd love to have your suggestions.

Hello, It's been years since I made a vid, but I finally got one finished recently and was wondering what the best place to upload it for hosting was? I remember one of the last vids I made was taken down from youtube for copyright infringement after a few months. Not sure if there is a better option or if youtube is pretty much the way to go for everyone?

[livejournal.com profile] grammarwoman suggested vimeo to me because you can password protect the vid, but I saw someone posted here about them installing some copyright infringement software earlier this year?

Any other suggestions or should I go with youtube? The music is from Fall Out Boy and the images are from Teen Wolf so I don't know if either are very stringent about their copyright rules or not.

And for comparison, here is how other gaming companies are approaching the issue of fanvids. Not all are following Nintendo's lead.

Once again, the OTW and the EFF (Electronic Frontier Foundation) presented persuasive arguments that - for the second time in a row - allows  vidders to legally break copyguard protection on video source (DVDs). Even more exciting is the fact that this year, the protection was extended to allow vidders to break encryption on downloaded source (ITunes video etc). 

[livejournal.com profile] giandujakiss provides a excellent summary here, which includes links to the actual arguments and the final Library of Congress ruling.  The OTW's reply brief includes my favorite line: "Lawyers, in general, should not be in the business of evaluating or interpreting art; the copyright laws are not designed to protect only that which lawyers think is worthwhile expression."

OK, so the subject line may not be wholly accurate.  This is not a post about how to fight a takedown notice or a forced audio swap of your vid (although you can find helpful tips on both topics from the OTW here).

It is a more practical post: how to use AO3 to create a stable "page" that you and everyone who loves and adores your vids can link to. A post where all the feedback and comments won't disappear overnight when your Yotube/Whatevertube account gets yanked.

The process is this: create a "page" on AO3 for your vid (like this one ). Upload your vid to your preferred streaming site  (see list below). Add the embed code and/or  link on your new AO3 page. If you password protect your vid, you add the password to the A03 post.  Most vidders add the word [Vid] in the title.

And you are done. If the vid at the streaming site gets taken down, you can upload to another site and replace the link. But the feedback, kudos etc you get on A03 won't disappear and you'll only need to update your links in one place. More in depth instructions are here

I have a question - and the answer may be obvious to some of you ("Hell no!") - but has anyone ever shown a fanvid as a sample of their knowledge in using a particular editing software, like Premiere Pro? Like, as a sample of their work, portfolio-style, almost. But you're basically showing them the video to show that yes, I know how to use this software. Except there's the thorny fact that you've got copyrighted material within that work, you know?

Any thoughts? I checked through the memories and have read up on various copyright and fair use articles/discussions. I'd like to hear your personal opinions in what you'd do in such a situation.

This was posted here earlier under lock, but I think it is important enough to post to the wider community.

Ning is the back bone provider for various video hosting sites like BAM Video Vault.  Their copyright policy is consistent with most other sites - which is - if they get a DMCA takedown request, they will comply, remove your work and give you the opportunity to file a counter notice. If you (or your social network) get too many DMCA notices, your account (or the networking site) may be shut down. Ning did this last year when too many of their Adult video networks received multiple DMCA notices from the porn industry - now, you cannot host any adult video content on Ning's platforms.

One thing to note: the concept of being a ‘repeat offender’ on Ning covers all of your accounts in all social networks hosted on Ning. In other words, the strikes can mount up and impact all accounts across all networks.


Starting this week, vidders on Buffytube (hosted on Ning) began receiving takedown requests from 20th Century Fox.  An excerpt from Ning's standard DMCA notice is included below. The Buffytube mods are closing the site and moving it elsewhere.

Hi everyone,

I'm just curious about the experiences of the vid-verse with copyright infringement suits: have you ever been hit with a takedown notice on YouTube or another site? What about a Cease & Desist letter? Has a media company ever threatened you with a suit? Was it the audio sample you used, or the visual footage that was the subject of the suit/letter/notice? I'm especially interested in hearing from any VCR vidders out there - did you ever come into direct contact with a media company for making a VCR vid?

This just popped into my head while reading Henry Jenkins' chapter in "YouTube: Online Video and Participatory Culture" by Jean Burgess and Joshua Green (2009), and made me curious if copyright suits are as common as many of us fear.

(Full disclosure: I am writing my PhD dissertation on vidding, so I may ask you to speak with me further if you are interested. No one will be quoted without their express consent and permission.)
